Terms of Service and End User License Agreement

Astryx is operated by Faisal Alhubail, an individual doing business as Astryx ("Astryx," "we," "us," or "our"), 6415 NW 102nd Path, Unit 206, Doral, FL 33178, support@astryx.life. These Terms of Service ("Terms") form a binding legal agreement between you and Astryx and govern your access to and use of the Astryx website at astryx.life, the Astryx application, its free tools, and its paid readings, guides, gift cards, and subscriptions (together, the "Service").

By creating an account, accessing any free tool, or making any purchase, you agree to these Terms and to our Refund Policy, which is incorporated into these Terms by reference. Our Privacy Policy separately governs how we collect, use, disclose, retain, and handle personal information; it describes our data practices and is not intended to create contractual warranties. If you do not agree to any part of these Terms, do not access or use the Service.

You represent and warrant that you can form a legally binding contract, that you are at least 18 years old, and that all information you provide is accurate and complete. If you use the Service on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.

Please read these Terms carefully. They include important provisions that affect your legal rights, including a binding arbitration clause and a class-action waiver in the "Dispute resolution and binding arbitration" section, and a limitation of our liability.

Astryx is a personalized astrology platform. Everything on the Service is provided for personal, informational, educational, and entertainment purposes only.

Free public tools are available to anyone without an account, including daily horoscopes, zodiac sign profiles, planet sign calculators, a compatibility tool, a transit calendar, and educational content.

Paid personalized readings are generated specifically for you based on your natal birth chart and the time period you select. Paid compatibility readings analyze the relationship between two natal charts and are delivered to your account immediately upon purchase.

Every reading and guide is created for you by an advanced AI language model working from your full natal chart, calculated from your exact date, time, and place of birth. It writes an original interpretation, in plain language, made only for you. It is an ancient interpretive tradition applied to your individual life, offered as insight for reflection, not as a statement of fact or a prediction of future events.

Readings are tools for self-knowledge and reflection. Nothing on Astryx constitutes financial, legal, medical, or psychological advice. Do not make major life decisions based solely on a reading. Please see the "No professional advice" section below.

You must be at least 18 years old to create an account or make a purchase on Astryx. By creating an account, you confirm that you meet this requirement.

Astryx does not knowingly collect personal information from anyone under the age of 13. If we become aware that an account has been created by someone under 13, we will delete that account and all associated data promptly. If you believe a person under 13 has provided us with personal information, please contact us at support@astryx.life.

Free content tools on Astryx are available without an account and require no personal data. The free personalized calculators (birth chart, rising sign, moon sign) ask for birth details to compute a result; those inputs are used only for that calculation and are not stored unless you are signed in or create an account. No age restriction applies to accessing these tools.

• You must provide a valid email address to create an account, and keep your information accurate and current.
• You are responsible for keeping your account credentials secure. Do not share your password with anyone.
• You are responsible for all activity that occurs under your account, whether or not you authorized it.
• You must notify us promptly at support@astryx.life if you suspect any unauthorized use of your account or any breach of security.
• You may only have one account per email address.
• We reserve the right to refuse service, and to suspend or terminate accounts that violate these Terms.

All readings and guides are digital products delivered immediately after purchase. Each reading purchase is a one-time transaction for a specific category and time period and is not a subscription unless you explicitly purchase a subscription plan. We may change our prices, products, and promotional offers at any time; any price change will not affect an order you have already completed.

Website purchases. On astryx.life, payments are processed securely by Stripe. Prices are listed and charged in US dollars (USD); your bank or card provider may apply a currency-conversion fee for non-US transactions. Applicable taxes are calculated automatically at checkout based on your location and added to the order total before you confirm payment. You authorize the charge, and for website subscriptions you authorize recurring charges until you cancel. We do not store your card details.

Apple App Store purchases. Purchases made in the Astryx app use Apple in-app purchase. For those purchases, billing, billing currency, taxes, payment processing, subscription management, renewals, and any refunds are handled by Apple through Apple's applicable systems and rules and the applicable End User License Agreement. Astryx does not process or store payment details for App Store purchases.

Immediate delivery and consent. By completing a purchase, you expressly request immediate delivery of the digital content and acknowledge that, once delivery begins, you lose any right of withdrawal or cancellation that would otherwise apply, to the extent permitted by law. This reflects Article 16(m) of the EU Consumer Rights Directive and Regulation 37 of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for digital content supplied other than on a tangible medium. Where mandatory consumer cancellation or withdrawal rights apply and cannot be waived, including under the consumer legislation of individual Canadian provinces, those rights are preserved. You confirm this consent by checking the agreement box at checkout before completing payment.

Availability. Purchased readings and guides are available in your account dashboard and can be re-downloaded as PDFs, subject to your account status, technical limitations, these Terms, and the continued operation of the Service. You may download and retain delivered content.

We reserve the right to refuse, cancel, or limit any order, including where we suspect fraud, an unauthorized or unlawful transaction, or a violation of these Terms. If we cancel an order after you have been charged and before the content was delivered, we will issue a refund for that order.

Astryx gift cards are purchased through the Astryx Shop. When you purchase a gift card you provide the recipient's email address, the amount, and an optional delivery date and personal message. We email the recipient at the scheduled time with their unique code.

Recipients claim a gift card by signing in to or creating an Astryx account and entering the code. Once claimed, the card's value is applied as a credit balance to the recipient's account and can be spent on any non-subscription Astryx product. The credit applies automatically at checkout and partial balances roll over within the same account.

Gift cards are not redeemable for cash except where required by law, not transferable once claimed, and do not expire. Gift cards cannot be used to pay for subscriptions or to purchase additional gift cards. We are not responsible for gift cards that are lost, stolen, or sent to an email address you entered incorrectly. We may void or reverse gift-card value obtained through fraud, chargeback abuse, or unlawful transactions.

Subscription plans automatically deliver new readings to your account on a fixed schedule, and you are billed monthly on a recurring basis until you cancel. Every plan covers all five life areas (General, Love, Career, Money, and Life Path); the plans differ only in how often a new reading is delivered, whether monthly, weekly, or daily. The price is a flat rate per plan and does not vary by the number of categories.

How you manage and cancel a subscription depends on where you subscribed. If you subscribed on our website, your subscription is billed by our payment processor, and you can pause or cancel it at any time from your account dashboard. If you subscribed in the Astryx app, your subscription is billed through your Apple account and renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period; you manage or cancel it in your Apple account or App Store settings, and cancelling from your Astryx dashboard will not stop an App Store subscription.

Price changes. Your subscription renews automatically until you cancel. Any change to the recurring price will be applied only in accordance with applicable law and the rules of the platform through which you subscribed, including any advance-notice and consent requirements. For App Store subscriptions, price-change notices and consent are handled by Apple.

Cancellation. If you cancel, your subscription remains active until the end of the current billing period, and you continue to receive the benefit of that period. Cancellation does not ordinarily produce a prorated refund for the current period, except where a refund is required by applicable law or by the applicable platform. Readings already delivered to your account remain available subject to the availability terms in Section 5.

You may pause a website subscription for up to 30 days from the Subscription tab in your dashboard. No reading is delivered and no charge is made during a pause.

Except where a refund, cancellation, replacement, re-performance, or other remedy is required by applicable law, personalized digital readings and guides are non-refundable once delivered, because each is prepared and delivered immediately upon payment and you have expressly consented to immediate delivery. Exceptions also apply where a reading was not delivered due to a technical failure on our end. Please refer to our Refund Policy for full details; the same mandatory-law qualification applies in the Refund Policy.

You agree not to, and not to permit anyone else to:

• Use Astryx for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms.
• Attempt to access another user's account or data, or any system or network connected to the Service, without authorization.
• Reverse-engineer, decompile, scrape, index, harvest, or copy the platform or its content, except as expressly permitted by law.
• Use any robot, spider, script, or other automated means to access the Service or collect data from it.
• Use the Service in a way that could damage, disable, overburden, or impair Astryx's infrastructure, or interfere with any other party's use of the Service.
• Circumvent, disable, or otherwise interfere with security-related features of the Service, or any rate limits or usage restrictions.
• Use readings, guides, or other outputs of the Service to build, train, or improve any competing product, model, or dataset.
• Upload or submit any content or personal data that you do not have the right to provide, or that infringes the rights of, or violates the privacy of, any third party.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Resell, sublicense, or commercially exploit the Service or any account without our written permission.

Some features require you to provide information, including birth details. When you purchase a compatibility reading, you provide birth details for a second person. You represent and warrant that you have obtained that person's consent, or that you otherwise have a lawful basis, to provide their information to us and to have it processed to generate the reading.

You are solely responsible for the accuracy of the information you provide and for your compliance with any applicable privacy or data-protection laws when you provide another person's information. We may, but are not obligated to, review, refuse, or remove any information or content that we believe violates these Terms or any law.

The readings and guides written for you are yours to keep and use personally. You are welcome to share your reading with others for personal, non-commercial purposes. You may not resell, republish, redistribute, or commercially exploit readings or guides without our written permission.

The Astryx name, logo, brand, website, application, software, educational content, designs, and all other materials that make up the platform are owned by Astryx or its licensors and are protected by intellectual-property laws. Except for the personal rights described above, nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property.

Software license. The Astryx application and software are licensed, not sold. Subject to these Terms, Astryx grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the application on devices you own or control, and to use the Service, solely for your own personal, non-commercial use, and, for the app obtained from the Apple App Store, only as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy (except as this license and those Usage Rules permit), modify, reverse-engineer, decompile, create derivative works of, rent, lease, lend, sell, redistribute, or make the application available over a network where it could be used by multiple devices at once, except to the extent applicable law permits. This software license is separate from, and does not limit, your rights to retain and personally use readings you have purchased. Astryx reserves all rights not expressly granted.

If you believe any content on Astryx infringes your intellectual-property rights, please contact us at support@astryx.life with details, and we will review your request.

If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, and incorporate that feedback for any purpose, without any obligation or compensation to you. You are not required to provide feedback, and you should not send us anything you consider confidential.

The Service relies on third-party providers (for example, for payments, hosting, and reading generation) and may contain links to third-party websites or resources. We do not control and are not responsible for the availability, content, products, services, or privacy practices of those third parties. Your use of a third-party service is governed by that provider's own terms and privacy policy, and any dealings you have with a third party are solely between you and that third party.

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. The Service may be unavailable from time to time for maintenance, updates, or reasons beyond our control.

We may add, change, suspend, or discontinue any part of the Service, including features, categories, and pricing, at any time and without liability to you. Some features may be offered on a trial or beta basis and may be changed or removed at any time.

The Service, including all readings and guides, is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that readings will be accurate, complete, reliable, or suitable for any particular purpose, or that the Service will meet your expectations. Astrology is an interpretive art, not a science, and readings are generated by automated systems as described above.

AI-generated content. You acknowledge that readings and guides are generated by an artificial-intelligence language model and that such content may contain errors, omissions, inconsistencies, or inaccurate or fabricated statements. AI outputs are probabilistic and may vary between generations, and similar or substantially similar outputs may be generated for you or for other users. We do not represent or guarantee that any AI-generated material is copyrightable or capable of exclusive ownership.

No oral or written information, advice, communication, or representation provided by Astryx or its representatives creates any warranty unless expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, our warranties are limited to the minimum extent permitted by applicable law.

Astryx is provided for personal insight, reflection, and entertainment. Nothing on the Service is, or is a substitute for, professional financial, legal, medical, psychological, or other professional advice, diagnosis, or treatment.

You should not rely on any reading or content as the basis for any decision, and you should always seek the advice of a qualified professional regarding any financial, legal, health, or other important matter. If you are experiencing a medical or mental-health emergency, contact a licensed professional or your local emergency services. You are solely responsible for the decisions you make and the actions you take.

You use the Service, and rely on any reading or content, at your own risk and discretion. You are responsible for evaluating the accuracy, completeness, and usefulness of any content, and for any consequences of your reliance on it.

To the fullest extent permitted by law, Astryx and its operators, owners, employees, contractors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability to you for any and all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) one hundred US dollars (USD 100), or (b) the total amount you actually paid Astryx during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in that case our liability is limited to the minimum extent permitted by law.

You agree to indemnify, defend, and hold harmless Astryx and its operators, owners, employees, contractors, and suppliers from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or your submission of another person's information without a lawful basis. We may, at our option and expense, assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense; you will not settle any such matter in a way that affects Astryx without our prior written consent.

You may stop using the Service and delete your account at any time from your account settings.

We may suspend or terminate your access to the Service, in whole or in part, at any time and without notice, if we reasonably believe you have violated these Terms or any law, if it is necessary to protect the Service or other users, or as otherwise permitted by law.

Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court, to have a judge or jury decide your case, and to participate in a class action.

Informal resolution first. Before starting an arbitration, you agree to send a written notice of dispute to support@astryx.life describing the claim and the relief sought, and to give us at least 30 days to resolve it in good faith. If we have a dispute with you, we will send our notice to the email associated with your account. This informal process is a condition precedent to beginning arbitration.

Agreement to arbitrate. If the dispute is not resolved within 30 days, you and Astryx agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including its formation, interpretation, breach, or termination, will be resolved exclusively by final and binding individual arbitration, rather than in court, except as set out below. This agreement to arbitrate is governed by the Federal Arbitration Act.

Administrator and rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, as modified by these Terms; the rules are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration consistent with these Terms, the parties will agree on a substitute administrator, and failing agreement a court of competent jurisdiction will appoint the administrator or arbitrator.

Fees. Filing, administration, and arbitrator fees are governed by the AAA Rules, and Astryx will pay or reimburse those fees to the extent required by the AAA Rules or applicable law. Each party is otherwise responsible for its own attorneys' fees and costs unless the arbitrator awards them as permitted by law.

Hearings. The arbitration may be conducted by written submissions, by telephone or video, or in person. Any in-person hearing will take place in the county of your residence or another mutually agreed location, consistent with the AAA Rules.

Arbitrator's authority. The arbitrator has exclusive authority to resolve the dispute, may award the same individual relief a court could, and will issue a reasoned written decision that may be entered as a judgment in any court of competent jurisdiction.

Class-action waiver. You and Astryx agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding, except as provided in the mass-arbitration provision below.

Mass arbitration. If 25 or more similar demands for arbitration are asserted against Astryx by or with the assistance or coordination of the same or coordinated counsel or entities, the demands will be administered under the AAA Mass Arbitration Supplementary Rules (or the AAA's successor rules for multiple or coordinated case filings) then in effect. Applicable statutes of limitation will be tolled for demands within the group that have not yet been filed while those rules are applied.

Exceptions. Either party may bring an individual claim in a small-claims court with jurisdiction, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual-property rights. Nothing in this section waives any right that cannot be waived under applicable law.

Jury-trial waiver. To the extent permitted by law, you and Astryx waive any right to a trial by jury.

30-day opt-out. You may opt out of this arbitration agreement and class-action waiver by emailing support@astryx.life within 30 days after you first accept these Terms, stating your name and that you wish to opt out. Opting out does not affect any other part of these Terms.

Severability. If the class-action waiver is found unenforceable as to a particular claim or request for relief, that claim or request will proceed in court rather than in arbitration, and all other claims will be arbitrated. If any other part of this section is found unenforceable, the remainder will stay in effect.

These Terms and any dispute arising out of them are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Subject to the arbitration section above, and only to the extent legally enforceable, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. Nothing in these Terms deprives you of the protection of any mandatory consumer-protection laws of your country of residence, or of any non-waivable right you may have to bring proceedings in the courts of your home jurisdiction.

We may update features, pricing, or these Terms at any time. Material changes to these Terms will be communicated by updating the date at the top of this page and, where appropriate, by other means. Your continued use of Astryx after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.

By using the Service, you consent to receive communications from us electronically, including by email and by notices posted on the Service, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. We may send notices to the email address associated with your account; you are responsible for keeping that address current. You can send notices to us at support@astryx.life.

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, epidemics or pandemics, power or internet failures, or the failure of third-party providers or infrastructure.

• Entire agreement. These Terms, together with our Refund Policy, are the entire agreement between you and Astryx regarding the Service and supersede any prior agreements. Our Privacy Policy separately governs our handling of personal information.
• Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. Any waiver must be in writing to be effective.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, including in connection with a sale or transfer of the Astryx business or its assets.
• No third-party beneficiaries, except that, for users who download the app from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
• Relationship of the parties. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Astryx.
• Export and sanctions compliance. You represent that you are not located in, and will not use the Service from, any country or region subject to comprehensive sanctions, and that you are not on any restricted-party list. You agree to comply with all applicable export-control and sanctions laws. You also agree not to use the Service for any purpose prohibited by US law, including the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
• Governing language. These Terms are offered in English, Spanish, and Arabic. The English version controls in the event of any inconsistency among the versions, to the extent permitted by applicable law; any mandatory local-language or consumer-protection right that cannot be waived is preserved.
• Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

These additional terms apply only if you download or use the Astryx application from the Apple App Store. In the event of any conflict with the rest of these Terms as to that use, this section governs.

• Acknowledgement. These Terms are concluded between you and Astryx only, and not with Apple Inc. ("Apple"). Astryx, not Apple, is solely responsible for the app and its content. Apple is not responsible for the app or these Terms.
• Scope of license. The license granted to you for the app is a limited, non-transferable license to use the app on any Apple-branded products you own or control, and only as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where applicable.
• Maintenance and support. Astryx is solely responsible for any maintenance and support services, as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.
• Warranty. Astryx is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. As between Astryx and Apple, any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Astryx.
• Product claims. Astryx, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of the app, including product-liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar laws.
• Intellectual property. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual-property rights, Astryx, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
• Developer name and contact. Any questions, complaints, or claims with respect to the app should be directed to Faisal Alhubail, doing business as Astryx, 6415 NW 102nd Path, Unit 206, Doral, FL 33178, support@astryx.life.
• Third-party terms. You must comply with applicable third-party terms of agreement when using the app.
• Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
